These general conditions of sale are
intended to regulate the online purchase of products put on sale to the public
by Vallnord – Pal Arinsal.
Vallnord – Pal Arinsal acts as a direct
organizer of his own services and activities as a ski and mountain resort, and
as a provider of intermediation services for various packages combined with,
and without accommodation facilities, offered by other external and different
operators in Vallnord – Pal Arinsal. It has administrative authorizations to be
able to market both its own products and services, as well as to provide the
intermediary service of other providers.
2 Use of website shop.vallnordpalarinsal.com
The customer is authorized to use this
website for the single purpose of legitimate queries or reservation, with the
consequent commitment to avoid speculative, false or fraudulent reservations.
However, the costumer undertakes to provide www.vallnordpalarinsal.com with
correct and precise contact information, such as email, and explicitly
designates such data as valid for notifications derived from this contract.
Vallnord – Pal Arinsal explicitly
guarantees that the technical means it uses in the making of its website and
commercial communications derived from it are restricted and protected from

3 Conditions Acceptance
Visiting and using this website implies the express acceptance by the
consumer of every and every general conditions that is considered automatically
incorporated into the contract, without the need to transcribe them
individually, and complete and develop the specific applicable legislation
without contravening it.
These conditions regulate the legal
relationship arising from the hiring processes carried out between users-costumers
and Vallnord – Pal Arinsal.

If the customer does not agree with the
General Conditions and/or with the Privacy Policy and Cookies, the latter

the General Conditions.
All notifications, requirements, petitions
and other communications to be made by the parties in relation to the present
General Conditions must be carried out in writing.
4 Conditions modify
Vallnord – Pal Arinsal reserves the right
to modify the present conditions in order to improve the services offered.
However, the amended general conditions will not affect the procurement of a
specific service, which will be regulated by those in force at the time of the
perfection of the contract. There will be no need for any express communication
of the modification of the conditions, but simple modification of the General
Conditions and exposure to the website: www.shop.vallnordpalarinsal.com, the
modification will be effective without the need for express communication or
other type. In any case, before hiring and using the services, the customer
will always be able to consult the conditions via this website.
The temporary validity of these general
conditions coincides with the publication time of these conditions until their
full or partial modification, from which time the modified general conditions
will come into force.
5 Online posted services acquisition contract object
and purchase system
a. Products offered on the web along with their price
and notable features will appear reflected on the screen. The indicated prices
are published in euros, and include IGI.
b. Vallnord – Pal Arinsal reserves the
right to modify the prices of products offered on the web, and will always be
considered as the basis of billing, the tariff(s) in force at the time the
reservation is made effective.
c. Vallnord – Pal Arinsal reserves the
right to decide at each time the products to be published and to be offered to
users via the web, and may in any case include other products that join
existing ones. However, Vallnord – Pal Arinsal reserves the right to delete at
any time and without needing warning, any of the elements it offers on its
website.
6 Customer contact information usage
The tenant customer of the reservation
ensures that he is over 18 years old and is legally able to hire, use the web and
contract legal obligations.
The customer ensures that any personal data
provided during the reservation procedure is correct and that he accepts
financial responsibility for any operation carried out under his name or
account.
Under these general conditions, the customer
authorizes Vallnord – Pal Arinsal to include all the personal data provided in
relation to a reservation, (both his and those of the people called on the same
reservation), in the Vallnord – Pal Arinsal confidential database for future
communications under both the regulations in force in the Principat of Andorra,
and in particular Law 15/2003 of 18 December of Protection of Personal Data, as
well as the General Regulation of Data Protection of the European Union (RGPD)
since 25 May 2018.
7 Applicable rules
The present General Conditions are subject
to the law of the Principat of Andorra, and to Law 8/2018 of payment services
and electronic money, Law 12/2013, of Trade, Law 13/2013, of effective competence
and consumer protection, Law 20/2014, of electronic procurement, and Law
35/2014 of electronic confidence services and the electronic confidence services
regulation.

Vallnord – Pal Arinsal acts as an
intermediary service provider between the customer and the different hosting
providers, and as a backup agent on behalf of the user, so that it does not
bear any responsibility for the quality of the service essentially provided,
nor any incidence or any other irregularities derived, directly or indirectly,
from the provision of services by the hotel or other external providers that
commercialize their accommodation and other services via the Vallnord – Pal
Arinsal web, which is totally alienated from any contractual, extracontractual,
or other type in the relationship between the hotel or supplier and the customer,
It is understood as hosting providers, all
that company, commercial name or owners, which appear on the website, and
include all the facilities and services offered on this website, which Vallnord
– Pal Arinsal is limited to booking on behalf of the user. The hotel
information has been provided by an external provider to Vallnord – Pal
Arinsal, so Vallnord – Pal Arinsal is not responsible for the terms provided by
the Law 20/2014.
9.1 Star classification
and host quality
Star
classification is own of the Principat of Andorra and is adapted to the rules
in force in the area. It merely serves as a general description and may not be
applied in all cases. The type of rooms that provide a hotel (e.g., individual,
double, or marriage) may vary according to the criteria of establishment. It is
the customer's responsibility to check the type of accommodation and services
provided by each hotel or partner agent. It is the responsibility of agent
partner to provide details about hotels, services or packages that can be
reserved through it, without the user being able to make any complaints.
The customer accepts that Vallnord – Pal
Arinsal has not carried out quality checks on the premises offered on the web
and that it is not responsible for the suitability of the accommodation, or the
services provided. Including web hosting does not in any way imply Vallnord-
Pal Arinsal recommendation or aval. Vallnord – Pal Arinsal declines all
responsibility for any inaccuracy regarding accommodation and services offered on
the website, which is the hotel exclusive responsibility, agent, or customer
for their specific verification
9.2 Tax on stays in
tourist accommodation
As soon as the M.I. Government of Andorra
enforces it by law, the customer will have to pay directly to the hosting provider
the amount corresponding to the taxation quota, in accordance with the tariffs
corresponding to the type of tax.
10 Ski & Mountain resort services
Vallnord – Pal Arinsal has the marketing
rights of the Arinsal Pal ski and mountain stations and has the authorizations
necessary for the sale on this site of the pass, and other services of its own
such as the Bike pass, the ski classes, snowboarding, or bike, derived
activities, catering services, or other related services that can be carried
out within the domains of Vallnord - Pal Arinsal. It is therefore a question of
the sale of own services, for which it assumes full responsibility for
management and development in an appropriate and proportional manner to what
has been employed.
11 Other Services
Vallnord – Pal Arinsal acts in this case
only as a provider of intermediary services between the customer and the direct
provider of these services and therefore assumes the status of a reserve agent
on behalf of the user, so that in no case will it be responsible for the
provision of services by providers and providers who market their services and
products via the web, who will take responsibility for all kinds, whether
contractual or non-contractual, in the provision of their services, without
Vallnord – Pal Arinsal being considered responsible in any case.
12 Reservations
The Reservations can only be formalizes via the web.
At the time of the reservation, 100% of the
total amount will be deposited; the reservation will only be considered firm
when this payment is made. Otherwise, it will be automatically cancelled and
the conditions described in the annellations section will be applied.
No reservation will be considered confirmed
if it is not fully paid 100% through a form of payment that does not allow
refunds and is considered definitive.
The customer is automatically responsible for the corresponding
documentation (confirmation and vouchers) upon reservation end, which will be
strictly necessary for the effective enjoyment of the activity or service
contracted.
The reservation includes the services
specified in the reservation confirmation. It is mandatory to read all the
hotel's information carefully, as it could contain supplements and extra services
with surcharge that the user should pay directly to the establishment, and of
which Vallnord – Pal Arinsal does not assume any kind of contractual,
extracontractual or any other type.
13 Payment
Purchase online: the payment is executed
for 100% of its amount at the time of the reservation.
Payment form: The payment of the services
contracted, which will appear on the screen, can be made using credit/debit
card. Transactions will be performed safely via the SSL protocol. In case the
TPV reported in Vallnord – Pal Arinsal the denial of the card with which the
user intended to pay, the reservation will be automatically cancelled,
informing the user of the fact.
14 Confirmation and vouchers
Once the customer has made the total
payment of the reservation as indicated above, he will automatically receive
the confirmation and the corresponding vouchers. These documents form the basis
of the contract for the reservation, and they credit the contracting of the
various services required by the customer. The customer fully assumes
responsibility for checking, conserving, and ensuring that all the details
contained in it are correct, as services can only be provided according to the
details specified in these documents (which are those that constitute the
current contract between the parties, and are an indispensable requirement for
the enjoyment of accommodation or service, to the conditions contracted).
15 Contractual documentation, perfection, and
acceptance
Due to the special characteristics of
distance hiring, the parties accept that it is impossible to sign the documents
under the contract on paper, or even the payment card. So, from the moment the
customer has accessed the web and hired electronically, he accepts the validity
of the electronic transaction generated as a result of the web reservation.
The person who completes the page's booking
form must be allowed to do so on behalf of all the members of the group with
whom they travel and must confirm that the people who are part of it accept the
terms of the reservation. In addition, this person is responsible for the total
cost of the reservation including cancellation or modification costs. However,
this person must inform the rest of the passengers of the details of the
confirmation, and any other relevant information that might interest them.
16 Insurance
Beyond the different types of insurance
available to the customer, it is reported that there is a ski insurance, or a
summer insurance, which in no case acts as travel insurance. These are products
which cover only medical expenses arising from injuries caused by the practice
of skiing or bicycles, and they also offer civil liability insurance to third
parties, with covered limits and guaranteed sums, which are reflected in the
particular and general conditions of the policy, which can be fully downloaded
and consulted before hiring it, at www.credit insurance.ad
In any case, the coverage would be strictly
during the practice of the activity of which one is treated, to tracks, between
9:00 and 18:00 according to the time of the year.
This insurance is full responsibility of
the service provider.
Insurance can be hired both on this website
and directly at the station ticket office by presenting the ski pass/bike pass
and before using any lift.
17 Hotel Cancellations and/or External Activities
If the customer changes or cancels the
reservation, there may be charges from the hosting provider or from the
services contracted. In any case, if he cancels his reservation within the
period set, there will be no cancellation charges. Each service provider has
its own cancellation policy, which is detailed both in its description of the website,
and also in the confirmation document.
In any case, and in general, if there is no
specification or detail, those described below are applied:
. Between 7 and 2 days earlier: it carries
a 50% charge of the hotel reserve and/or activities.
. In the last 48 hours of the contracting
service, or not presented, will result in the total loss of the amount paid for
accommodation or activities.
Under no circumstances will the partial or
total refund be made, for services contracted and not used voluntarily by the
customer, with communication of less than 8 days.
18 Lift Pass Cancellations, Courses or Restaurants
If the customer modifies or cancels his reservation
for station services, the following charges will be applied :
. In the last 48 hours immediately to the
contracted service, or not not presenting at the scheduled date, it will result
the total loss of the amount paid by litft passes, courses or restaurants.
Under no circumstances will the partial or
total refund be made, for services contracted and not used voluntarily by the
customer, with communication of less than 48 hours.
19 Reclamations
Irregularities or deficiencies that the
customer may find in the services employed will be notified directly to the
service provider in question as long as he uses and enjoys it, and he has
provided the opportunity to rectify the situation from start.
In case the solution provided is not
satisfied, the customer will have to contact the Vallnord-Pal-Arinsal Reservation
Center in writing, from where the appropriate arrangements are made to pursue
the claim: shop.palarinsal.vallnord.com on behalf and on behalf of the
customer.
The customer is also informed that the
establishment must have the official complaints book and be given the
opportunity to make the complaint directly.
20 Definition of responsibility for the possible
inaccuracy of information provided by external service providers.
The customer recognizes and accepts that
Vallnord – Pal Arinsal is in no way responsible for the inaccuracies of
information provided by external service providers, as detailed in these
general conditions.
The customer is informed that Vallnord –
Pal Arinsal does everything possible to ensure that the service providers
offered by Vallnord – Pal Arinsal keep all the information contained in this
website up-to-date and accurate even though he is not responsible for verifying
and correcting it.
As a result, the customer is informed and
accepts that information and prices contained in this website are subject to
variations and are provided exclusively for information.
21 Force majeure and responsibilities
Vallnord – Pal Arinsal is not responsible
for any change, cancellation or modification of the reservation, or for the
losses or damage caused, for the failure of service providers to comply with
any of the respective obligations towards the customer, as has been indicated
previously.
Vallnord – Pal Arinsal will only respond to
the consumer for the obligations it has to fulfil the various own services
contracted via the web, except:
When this breach was caused by
circumstances of force majeure. These circumstances include, by way of an
enunciative but non-constraining circumstances: wars, revolutions, terrorist
attacks, border closures, epidemics or pandemics, natural disasters or any
other circumstances that may seriously affect both parties, as well as any
other unforeseeable circumstances outside the control of Vallnord-Pal Arinsal.
When defects are
attributable to the consumer, the sales agency or the establishment, Vallnord –
Pal Arinsal reserves the right to modify or suspend scheduled activities if,
according to their criteria, it is necessary, or if, for any other reason, it
is not possible to do so.
If the consumer has been recruited via the
web, and if he appreciates in situ the non-execution or bad execution of the
services employed in the stay, he must immediately notify the service provider,
and within 48 hours of working hours, of the necessary measures. Non communication
to Vallnord – Pal Arinsal within the given time entails the inability of
Vallnord – Pal Arinsal to have the necessary evidence of non-compliance and its
circumstances, and it will therefore be the consumer who will have to test the
failure to comply with the implementation of the contract earlier by the
relevant authorities, making it possible for a satisfactory solution to be

22 Industrial and Intellectual Property
All intellectual and industrial property
rights (the website's content and its graphic design, logos, and trademarks),
are exclusive property of Vallnord – Pal Arinsal, and it is for them to
exercise the exclusive right to exploit them. Thus, their reproduction,
distribution, public communication, and modification, total or partial, without
prior express authorization from Vallnord – Pal Arinsal, is banned. Similarly,
all distinctive signs, trademarks, trade names or signs of any kind contained
on the website, documents, advertising, and others in which leaves Vallnord –

23 Personal Data Treatment

the delivery of electronic commercial communications, by means of written
communication aimed at Vallnord – Pal Arinsal by sending an email to the

To exercise these rights, Vallnord – Pal
Arinsal will be able to require the customer to send a copy of his passport or
identity document.
24 Legislation and jurisdiction
The application and interpretation of these
general conditions will be governed by the current legislation of the Principat
of Andorra. In case of any discrepancy that may arise in the interpretation or
execution of any of these conditions, the parties, with express resignation
from their own fur, if they had it, are subject to the jurisdiction and
jurisdiction of the Andorran courts.
Vallnord – Pal Arinsal will be able to
offer an alternative way of resolving disputes between the customer and the
service provider, where technically possible.
